Apple Asks US to Ban Imports of Ericsson Telecom Equipment

According to sources in international media, Apple has struck back in the latest round of patent conflicts with Ericsson, countersuing Ericsson and urging the US International Trade Commission (ITC) to prohibit the importation of its mobile infrastructure equipment

The iPhone maker claims Ericsson's millimeter-wave antenna RUs and baseband units infringe on its patents, but it points out that if the ITC grants its request, none of the supplier's devices are made in the United States will be affected.

 

According to reports, Ericsson has filed a lawsuit in the Eastern District of Texas, with additional lawsuits filed in the Western District of Texas and other countries, including Germany, alleging that Apple has infringed on a total of 12 Ericsson independent 5G patents. Apple has filed a counterclaim with the US International Trade Commission, requesting a ban on the import of infringing equipment. The question of patent fees is, of course, the source of the two sides' quarrel. Ericsson wants to keep the existing patent cost of $5 (about 31 yuan) per device, but Apple believes Ericsson is asking for too much and refuses to pay it.

 

 

Apple's lawsuit, according to Foss Patents, requests the ITC to impose a U.S. import restriction on Ericsson's mobile infrastructure goods. The items, according to Apple, infringe on three of its millimeter-wave patents. The main point of contention between the two parties is 5G patents. Apple has a large number of 5G patents since acquiring Intel's modem division, which can be used as a bargaining chip in legal proceedings. In the communications market, however, Ericsson has a greater presence than Apple. Ericsson was a very early participant in 5G technology patent contributions and made a significant contribution to 5G technology. It all relies on which party's patent finding is upheld by the court in the end.
