There are several types of bailiffs in the United Kingdom, and each has its own set of powers depending on which body it represents. County court bailiffs, high court enforcement officers, and certified enforcement agents are the three most common types of bailiffs.

In some cases, bailiffs may visit your home in search of someone else. 

This could happen for one of two reasons: the bailiff is looking for a friend or family member who shares your address, or they are looking for the wrong person. If the bailiff is looking for someone who is not known to you at your address, it is best not to let them in. 

Instead, request that they speak with you at a safe distance from your door. Going to show them a document to prove your authenticity, such as a council tax or utility bill, will usually cause them to leave.

Alternatively, you can call the company or court that sent them and explain the error.

If the bailiff is looking for someone with whom you live,

Living with someone does not obligate you to pay their debts. In this case, inform the bailiff that the person they are looking for is not at home.

Under any circumstances, if this is their first visit, they cannot enter your home without your permission. If they have a warrant, they can enter.

Can bailiffs enter a property?

Bailiffs can only enter if certain conditions are met. They are not permitted to break down a door, but depending on the type of debt owed, they may return with a locksmith.

Bailiffs may enter by force in the following situations:

  • If they have a warrant from a magistrate's court.
  • To seize goods if they have been moved to another property.
  • If they have previously gained peaceful entry to your home.

Can bailiffs enter your home while you are not present?

In general, bailiffs are not permitted to enter your home if no one is present. They can, however, attempt to enter peacefully if a family member is present at the time of their visit.

If you are not present, the bailiff may look through your windows, if possible, to make a list of any items that can be seized. They will then leave you a notice informing you that they attempted to visit you.

It's also worth noting that if bailiffs are collecting criminal fines, VAT debts, or this isn't their first visit, they may be able to force entry regardless of whether you're present.

In England and Wales, an Individual Voluntary Arrangement, or IVA, is a formal debt solution. It works by converting your unsecured debt into manageable monthly payments and allowing you to discharge debts that you cannot afford to repay.
