What are Oklahoma's laws on medical marijuana? (New Laws 2023)

The Oklahoma Medical Marijuana Act (OMMA) is the body that oversees the licencing, registries, approvals, and distribution of medical marijuana. It was approved by voters in Oklahoma State Question 788, also known as the Medical Marijuana Legalization Initiative, in 2018.

Medical marijuana laws in Oklahoma

Registration for Caregiver.
Depending on whether they will be helping an adult or a child patient, carers must submit the appropriate carer registration form. Up to two authorised parents or legal guardians may be chosen by minor patients.

Fees for an Oklahoma medical marijuana card

  • $100 application fee for all patients.
  • $20 for beneficiaries of Medicaid and Medicare or handicapped veterans.
  • Free for those who provide care.

Limits and Penalties for Possession
Only individuals who have registered as OMMA patients or carers are authorised to possess medical marijuana. Up to

  • 3 ounces (85 grammes) of usable cannabis can be kept on the person carrying the patient or carer, and 8 ounces (227 grammes) can be kept at home.
  • 28 grammes of cannabis concentrates, or 1 ounce.
  • 2 kilos (72 ounces) worth of food.

General Consumption
Any use of marijuana in public is prohibited and subject to legal penalties. Therefore, the patient should only consume it in the privacy of their own home or another secure location.

Smoking:  Smoking is also only permitted in private settings, and it should never be done in front of children.

Driving : It is forbidden to use marijuana while operating a car or travelling in one. The OMMA in Oklahoma also forbids driving when intoxicated.

Workplace Discrimination  : Because of their status in the MMJ registry, employees are strictly prohibited from being treated differently under the OMMA statute. An employee's use of medical marijuana cannot be the sole factor used to determine whether to recruit, terminate, or discipline them.

Oklahoma's cultivation regulations

Patients who decide to grow their own plants can have

  • six ripe plants
  • 6 young plants
    Any other type of marijuana plant growing is prohibited in the state. A fine and/or incarceration are imposed for having plants or seeds on the person of a non-patient.

In Oklahoma, is marijuana legal?

Since 2018, there has only been a partial response to the question "Is weed legal in Oklahoma?" For patients who meet the requirements, the state government approved a law allowing medical marijuana use. These patients are required to enrol in the state's programme and claim any medical marijuana they have been prescribed.

Conditions to Meet
In contrast to other states, Oklahoma does not establish a set of ailments that a patient must have in order for the state to declare them eligible. A prescription or written advice from a qualified medical professional is required.

  • An agitated form of Alzheimer's
  • Acute Myeloid Leukemia (ALS)
  • Any persistent or incapacitating medical condition, illness, or remedy for a condition that results in cachexia or wasting syndrome.
  • Cancer
  • Chronic discomfort brought on by arthritis or migraines
  • The illness Crohn's
  • Glaucoma
  • AIDS or HIV
  • Post-traumatic stress disorder and hepatitis C (PTSD)
  • Acute nausea
  • Severe or ongoing muscle cramps, such those brought on by multiple sclerosis
  • Seizures, especially epileptic seizures
