Scholars differed concerning this issue. Some of them said that marriage with the intention of divorce is a temporary marriage. Because the married person intended for a specific period of time, and the Prophet - may God’s prayers and peace be upon him and his family - said: “Actions are but by intentions, but each person has what he intended.” And because the lawful husband who marries a woman whose husband divorced her three times with the intention of divorcing her if he marries her, even if he did not stipulate it in the contract, rather he intended divorce only, then he is lawful, and the wife does not become permissible for the first husband, so the intention here affected the validity of the contract, so is the intention of divorce If he returns to his country and others say that this is not a temporary marriage; Because a temporary marriage is stipulated in a condition that he divorces her within such-and-such a period, or that the marriage lasts for such-and-such, unlike if he intends to divorce only. Therefore, if the period in the temporary marriage is completed, the marriage is annulled without annulment and interdiction, and the intention of divorce is not like that, as it is possible that he wants the wife to remain with him even if He had married her with the intention of divorce, but I have something forbidden in him other than this, which is that he cheats the wife and her family, because perhaps if they knew that he would not marry her out of desire and survival, they would not marry him, i. From this point of view, not from the point of view of being a temporary marriage, and therefore it is forbidden But the contract is valid; Because this prohibition does not go back to the same contract.

Coming to a woman in her anus is a major sin. Because it contradicts His saying, Glory be to Him: {Your women are a tilth for you, so go to your tilth as you wish} [Al-Baqara: 223] and the place of tilth is the kiss, and for the words of the Prophet - may God’s prayers and peace be upon him -: “Cursed is he who has intercourse with his wife in her anus.” And whoever repents, God will repent to him, and the woman is not divorced. But they must all sincerely repent of that. For the saying of God - the Mighty and Majestic -: “And repent to God all, O believers, so that you may succeed” [An-Nur: 31] And the Prophet - may God’s prayers and peace be upon him - said: “Repentance obligates what came before it.” And he, may God’s prayers and peace be upon him, said: “The one who repents of sin.” Like someone who has no fault.” And God is the Grantor of success.

And what I see regarding divorce during menstruation and purification in which sexual intercourse took place, and which I issue fatwas with, is that divorce occurs for two reasons.One of them : the hadeeth of Ibn Umar, and the fact that the shot was counted on him. And the second: I do not know of any of the hadiths that the Prophet - may God’s prayers and peace be upon him - inquired from the divorced person when asked about divorce, whether he was divorced during menstruation, or during a period of intercourse, and if the ruling was different, it would be necessary to inquire, and I do not know that I issued a fatwa not to fall unless Once, and I am still looking for more evidence of its occurrence or non-occurrence, and the seeker of knowledge should always be a seeker of the truth with its evidence until he meets his Lord - the Mighty and Majestic.-. As for swearing by divorce, I used to give fatwas in the past about the occurrence of the divorce, then it appeared to me recently about a year or a little more that it did not fall, and I issued fatwas with that many times if the divorcer did not want the divorce to occur when the condition was fulfilled, but rather wanted another meaning such as urging, preventing, or ratifying Or a denial, and it is no secret that this is the choice of Shaykh al-Islam Ibn Taymiyyah and his student, the scholar Ibn al-Qayyim, may God have mercy on them both.. As for the divorce of anger, the one who is fathomed by the occurrence is as long as it is not intensified until it changes the feeling, or the divorced person mentions that he does not know what happened from him except by the words of those present with him. All these types are not permissible; Because it is a violation of the purified law, but the legal marriage is the declaration that includes the pillars of marriage and its conditions that are legally considered. God grants success.
