Criminal justice is a term that is used in a variety of contexts. Still, the most common place it is used is to refer to the series of events, actions, or activities that make up the official response to order problems and perceived laws, such as court hearings, crime prevention, and the enforcement of court orders.

As a result, to control crime and penalize those breaking the law, the government's or state's system of legislation, organizations, and policies are used to maintain social control and deterring.

We will discuss different people's roles in maintaining control over crime, such as Police, prosecutors, and judges. Because criminal law is something not everyone is aware of, and at certain times we seek criminal law help.

Before coming to the roles, there are a few things that I am going to mention about why criminal law is important.

  2. To keep up with society's laws and orders

  4. Compensation for the victims

  6. Penalties from criminals.

The Role of Courts

The court plays an important role in the administration of justice. Before making any decision, the court verifies the facts and arguments presented by both parties: defendants and appellants, through their lawyers. Depending on the satisfaction or dissatisfaction with the district court's decision, one can appeal to the high court first and afterward to the supreme court.

Role of Judge in the Criminal Justice system

A judge is someone who is appointed to preside over court proceedings. The judge makes decisions based on facts and arguments presented by both parties. They interpret the meaning of the law, repercussions, and relevance fairly and objectively. Judges shall not only read the law but also must show compassion and empathy to all the parties involved. When the case is brought initially to the court, the judge must determine whether the evidence is sufficient enough to establish a reasonable conclusion of the crime occurrence and whether the person accused is the one who did it. 

An attorney shall be appointed to the defendant by the judge if they cannot afford one. The judge determines bail based on the amount of bail; the defendant enters a guilty or a nonguilty plea. The judge must ensure that the plea was entered voluntarily.

The following mentioned are the points that the judge has to take care of in the criminal justice system-

  • Judge has to make sure that the trial is fairly and transparently done.
  • A judge hears all the witnesses produced by the prosecution and defense.
  • If the accused is guilty, a penalty will be imposed.
  • The decision if the accused is guilty or not shall be made on the evidence given
  • Depending on the law, a judge has the authority to sentence the accused to prison, fine, or do both

Public Prosecutor's Role

Public prosecutors are the ones that are state-appointed, gazetted offices that assist in the prosecution of criminals to maintain a crime-free society. Prosecutors are expected to be unbiased and do the needful to bring justice. It doesn't matter whether the evidence is in favor or against; he has to ensure every piece of evidence is presented to the court.

Suppose we compare cognizable and non-cognizable offenses that are less serious and are known as non-cognizable offenses and vice versa. Some examples of non-cognizable offenses are violence, public annoyance, mischief, etc. Non-cognizable offenses are not recorded by PolicePolice only a warning is given without the proceeding of any arrest.

The Role of Police

The Police are the first people individuals contact to report any crime. The primary duties of law enforcement include investigations, detention, apprehension, and detention of individuals suspected of criminal offenses, which are all taken care of by the PolicePolice.
