What is the ruling on marriage with the intention of divorce upon returning to his country?

11 min read

Scholars differed concerning this issue. Some of them said that marriage with the intention of divorce is a temporary marriage. Because the married person intended for a specific period of time, and the Prophet - may God’s prayers and peace be upon him and his family - said: “Actions are but by intentions, but each person has what he intended.” And because the lawful husband who marries a woman whose husband divorced her three times with the intention of divorcing her if he marries her, even if he did not stipulate it in the contract, rather he intended divorce only, then he is lawful, and the wife does not become permissible for the first husband, so the intention here affected the validity of the contract, so is the intention of divorce If he returns to his country and others say that this is not a temporary marriage; Because a temporary marriage is stipulated in a condition that he divorces her within such-and-such a period, or that the marriage lasts for such-and-such, unlike if he intends to divorce only. Therefore, if the period in the temporary marriage is completed, the marriage is annulled without annulment and interdiction, and the intention of divorce is not like that, as it is possible that he wants the wife to remain with him even if He had married her with the intention of divorce, but I have something forbidden in him other than this, which is that he cheats the wife and her family, because perhaps if they knew that he would not marry her out of desire and survival, they would not marry him, i. From this point of view, not from the point of view of being a temporary marriage, and therefore it is forbidden But the contract is valid; Because this prohibition does not go back to the same contract.

The rule of intercourse with the wife in her anus and do you call him?
Question: What is the ruling on the husband having intercourse with his wife in her anus, and if this happens several times, is she divorced, and if the spouses have repented of this act, what is their ruling? May Allah reward you well
. Answer:
Coming to a woman in her anus is a major sin. Because it contradicts His saying, Glory be to Him: {Your women are a tilth for you, so go to your tilth as you wish} [Al-Baqara: 223] and the place of tilth is the kiss, and for the words of the Prophet - may God’s prayers and peace be upon him -: “Cursed is he who has intercourse with his wife in her anus.” And whoever repents, God will repent to him, and the woman is not divorced. But they must all sincerely repent of that. For the saying of God - the Mighty and Majestic -: “And repent to God all, O believers, so that you may succeed” [An-Nur: 31] And the Prophet - may God’s prayers and peace be upon him - said: “Repentance obligates what came before it.” And he, may God’s prayers and peace be upon him, said: “The one who repents of sin.” Like someone who has no fault.” And God is the Grantor of success.

Does divorce occur in menstruation and in the purification of her intercourse in it?
from m. s. a. To our Sheikh Abdul Aziz bin Abdullah bin Baz, may God protect him, Amen. Peace, mercy and blessings of God be upon you. I ask God to grant you health and wellness, and to grant us and you gratitude for His grace and steadfastness in the religion. And yet: I knew that you issued fatwas regarding the occurrence of the three divorces as one, if it was in one sitting. Previously, my heart was not reassured to answer according to this. However, very recently, it became clear to me the clear evidence of the Qur’an for that, and I dared to do so, especially after it became clear to me the greatness of the tragedies that result from the permanent separation between the spouses if this is related to one word that comes out of the husband’s mouth.. But my question now is: Do you issue fatwas regarding the occurrence of divorce during menstruation and purification in which contact between the spouses occurred, or do you issue fatwas regarding its non-occurrence? If you issue fatwas regarding its occurrence, then what is the difference for you between it and the three divorces in one sitting? Since both are contrary to the legitimate aspect, the ruling should be the same. And if you are fatwas that it does not occur, should the mufti and the ruler inquire from the divorced person about the condition of the woman when pronouncing the divorce? I would also like to know your opinion on the issue of swearing by divorce. The issue of divorcing one who is angry is an anger that takes a person out of his natural phase without bringing him to closure, and in these two issues I do not need to know the inference, but rather I intend to know what you say.. This is what is necessary, and my greetings to your children, sheikhs, brothers, and all your loved ones. Peace. From Abdul Aziz bin Abdullah bin Baz to the Honorable Brother, His Eminence Sheikh M. s. a. God bless him and all that is good. Amen. Peace, mercy and blessings of God be upon you, after himYour noble letter dated 10/12/1389 A.H. has arrived, and may God bless you with His guidance, and what it contained of the statement about your desire to know my opinion on the ruling on divorce in menstruation and purification in which a man had intercourse with his wife, swearing by divorce, divorce in anger, etc. was known.

And what I see regarding divorce during menstruation and purification in which sexual intercourse took place, and which I issue fatwas with, is that divorce occurs for two reasons. One of them : the hadeeth of Ibn Umar, and the fact that the shot was counted on him. And the second: I do not know of any of the hadiths that the Prophet - may God’s prayers and peace be upon him - inquired from the divorced person when asked about divorce, whether he was divorced during menstruation, or during a period of intercourse, and if the ruling was different, it would be necessary to inquire, and I do not know that I issued a fatwa not to fall unless Once, and I am still looking for more evidence of its occurrence or non-occurrence, and the seeker of knowledge should always be a seeker of the truth with its evidence until he meets his Lord - the Mighty and Majestic.-. As for swearing by divorce, I used to give fatwas in the past about the occurrence of the divorce, then it appeared to me recently about a year or a little more that it did not fall, and I issued fatwas with that many times if the divorcer did not want the divorce to occur when the condition was fulfilled, but rather wanted another meaning such as urging, preventing, or ratifying Or a denial, and it is no secret that this is the choice of Shaykh al-Islam Ibn Taymiyyah and his student, the scholar Ibn al-Qayyim, may God have mercy on them both.. As for the divorce of anger, the one who is fathomed by the occurrence is as long as it is not intensified until it changes the feeling, or the divorced person mentions that he does not know what happened from him except by the words of those present with him. The husband, in one wording, is: The text came explicitly in the non-occurrence of the three, and that it was made one during the era of the Prophet - may God bless him and grant him peace - and the era of Abu Bakr - may God be pleased with him - and the first era of Umar - may God be pleased with him - and nothing like this came in divorce in Menstruation, and the purification in which the politicized person fell, and since the hadith about the non-occurrence of the three is not explicit in the non-occurrence of the separate three, I carried it on whether it occurred with the wording of one; because that is the least evidence of it; And because Ibn Abbas - may God be pleased with her - issued a fatwa with that in the narration that came from him in the absence of the rhythm of the three, and because I did not find from any of the predecessors until my time this explicit wording that indicates that the separated three do not count.. This is a summary of what I have on the subject, and when it appears to your Eminence that it is contrary to what I mentioned with evidence that you are reassured about, then I hope to inform you of that. Because the truth is the lost of the believer, and the benefit is required from me and from you, and from every seeker of knowledge, who investigates the truth. May God help me and you and all of our brothers to attain the truth in speech and action, and to be steadfast in it, for He is the best of those responsible. Total Fatwas of Sheikh Ibn Baz (21/278- 282) https://fatawapedia.com/%D9%87%D9%84-%D9%8A%D9%82%D8%B9-%D8%A7%D9%84 %D8%B7%D9%84%D8%A7%D9%82-%D9%81%D9%8A-%D8%A7%D9%84%D8%AD%D9%8A%D8%B6-%D9% 88%D9%81%D9%8A-%D8%B7%D9%87%D8%B1-%D8%AC%D8%A7%D9%85%D8%B9%D9%87%D8%A7-%D9 %81%D9%8A%D9%87-21308

Ruling on secret, customary, temporary, and misyar marriages
The question:
We hear about secret marriage, customary marriage, temporary marriage, and misyar marriage, so what is the Sharia ruling on these marriages? Hopefully useful, thanks.
All these types are not permissible; Because it is a violation of the purified law, but the legal marriage is the declaration that includes the pillars of marriage and its conditions that are legally considered. God grants success.
